A RESOLUTION SUPPORTING THE CALLING OF A SPECIAL QUESTION ELECTION IN SHERMAN COUNTY KANSAS, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF THE COUNTY THE QUESTION OF IMPOSING A ONE PERCENT (1%) COUNTY-WIDE SALES TAX FOR FINANCING THE COST OF MAKING CERTAIN STREET AND ROADWAY IMPROVEMENTS IN SHERMAN COUNTY, KANSAS.   

            WHEREAS, K.S.A. 12-187 et seq., as amended, including K.S.A. 12-187(b)(8) (the “Act”), authorizes the Board of County Commissioners (the “Board”) of Sherman County, Kansas (the “County”) to submit to the electors of the County the question of imposing a county-wide retailers’ sales tax for the purpose of financing street and roadway improvements in the County; and

            WHEREAS, pursuant to the Act, the County currently imposes a one percent (1.0%) county-wide retailers’ sales tax (the “Existing Sales Tax”) to pay the costs of street and roadway improvements in the County; and

            WHEREAS, the Existing Sales Tax will expire by its terms on July 1, 2023; and

            WHEREAS, the Board has determined that it is necessary and advisable to make improvements to certain streets and roads within the County (the “Improvements”), including streets and roads maintained by each of the County, the City of Goodland, Kansas (the “City of Goodland”) and the City of Kanorado, Kansas (the “City of Kanorado”); and

            WHEREAS, the Board finds that the Improvements benefit the economic and community development and public welfare of the County and its environs, including the City of Goodland and the City of Kanorado; and

            WHEREAS, the Board deems it advisable to provide for the calling of a special question election in the County for the purpose of submitting to the qualified electors of the County the question of imposing a special one percent (1.0%) county-wide retailers’ sales tax (the “Sales Tax”) for the purpose of paying the costs of the Improvements; and

            WHEREAS, the proceeds of such Sales Tax are to be apportioned in accordance with an interlocal agreement, as follows:  70% to the County, 25% to the City of Goodland, and 5% to the City of Kanorado; and

            WHEREAS, in order to authorize such Sales Tax, it is deemed advisable to call a special question election in the County to be held on November 8, 2022; and

            WHEREAS, the Sales Tax, if approved, would commence upon expiration of the Existing Sales Tax, on July 1, 2023, and expire 20 years after it commences, upon payment of all costs of financing the Improvements; and

            WHEREAS, the City Commissioners of the City of Goodland, Kansas (the “Governing Body”) has reviewed the proposed ballot question with Sherman County Board of County Commissioners and the City of Kanorado representatives and agrees with the determination that it is necessary and advisable to make improvements to certain streets and roads within the City as part of “The Improvements” listed in the proposed ballot question; and

            WHEREAS, the Governing Body deems it advisable to support the Board of County Commissioners in the calling of a special question election in the County for the purpose of submitting to the qualified electors of the County the question of imposing a special one percent (1.0%) county-wide retailers’ sales tax (the “Sales Tax”) for the purpose of paying the costs of the Improvements; and

            NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF GOODLAND, KANSAS:

            SECTION 1.  The City of Goodland supports the Board of County Commissioners in the calling of a special question election in the County for the purpose of submitting to the qualified electors of the County the question of imposing a special one percent (1.0%) county-wide retailers’ sales tax (the “Sales Tax”) for the purpose of paying the costs of the improvements to certain streets and roads within the County (the “Improvements”), including streets and roads maintained by each of the County, the City of Goodland, Kansas (the “City of Goodland”) and the City of Kanorado, Kansas (the “City of Kanorado”).
