ORDINANCE NO. 1825

AN ORDINANCE ADOPTING AND AMENDING SECTIONS 16-401 through 16-409 and SECTION 16-411 OF THE CITY OF GOODLAND MUNICIPAL CODE REGARDING BICYCLES, ELECTRIC ASSISTED BICYCLES, SKATEBOARDS, SCOOTERS, ELECTRIC SCOOTERS, ETC. 

NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GOODLAND, KANSAS:  

Section 1. The City of Goodland Municipal Code Section 16-401 through 16-409, and Section 16-411 is amended to adopt the following:

ARTICLE IV. BICYCLES, ELECTRIC ASSISTED BICYCLES, SKATEBOARDS, SCOOTERS, ELECTRIC SCOOTERS, ETC.

Sec. 16-401. Definition.

(a)           A device is defined as any human- or electric-powered means of transport upon which a person may ride.

(b)           Pocket bike shall be defined as any device with two tandem wheels or three wheels, propelled by a gasoline engine, that lacks a vehicle identification number and cannot be registered for ownership.

(c)            Electric Dirt Bike is defined as an off-road motorcycle powered by a rechargeable lithium-ion battery and an electric motor instead of a gas engine.

(d)           Electric Scooter is defined as a battery-powered, two-wheeled device featuring a standing deck, handlebars, and a small motor.

(e)           Electric Bicycle is defined as a regular bicycle equipped with a rechargeable battery and an electric motor that helps power the pedals or move the bike forward.

Sec. 16-402. Traffic regulations apply to persons riding bicycles, electric-assisted bicycles, and electric scooters.

Every person riding a bicycle, electric-assisted bicycle, scooter, or electric-assisted scooter upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by this chapter except as provided in this article and except as to those provisions of this chapter which by their nature can have no application.

Sec. 16-403 – Operation of Electric Scooters and Electric-assisted Bicycles; Equipment required for operators and riders. 

No person under the age of 12 years shall operate or ride an Electric Bicycle or an Electric

Scooter unless wearing a helmet which complies with minimum guidelines established by the

National Highway Traffic Safety Administration pursuant to the National Traffic and Motor

Vehicle Safety Act of 1966 for helmets designed for use by motorcyclists and other motor

vehicle users.

Sections 16-404 through 16-408 are no longer in use.

Sec. 16-409. Use of bicycles, electric bicycles, scooters, electric scooters, coasters, roller skates, skateboards, and similar devices on Main Street.

(a)           It shall be unlawful for any person to operate or use a bicycle, electric bicycle (e-bike), scooter, electric scooter, coaster, roller skates, skateboard, or any other similar device on the sidewalks in the following described areas of the City of Goodland: Main Street from 8th Street to 17th Street; The 100 block of both east and west from 8th Street to 17th Street.

(b)           It is unlawful for any person to operate or use a bicycle, electric bicycle (e-bike), scooter, electric scooter, coaster, roller skates, skateboard, or any other similar personal transportation or recreational device on Main Street between 8th Street and 17th Street during the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday.

                This restriction applies exclusively to the designated section of Main Street during the specified days and times. The purpose of the ordinance is to limit the use of these devices within the downtown corridor during normal business hours, when pedestrian and vehicle traffic are typically at their highest. Use of these devices outside the restricted area or outside the specified days and hours is not prohibited by this provision, although other applicable laws or local ordinances may still govern their operation.

Sec. 16-411. Pocket bikes and Electric Dirt Bikes prohibited.

The operation of electric dirt bikes and pocket bikes on the streets, roads, and alleys within the corporate limits of the City of Goodland is prohibited.

Nothing in this section prohibits the operation of an electric dirt bike on a public street

by an authorized operator who holds a valid driver’s license and has obtained all

required equipment, state registration, and insurance necessary for lawful street

operation.

SECTION 2. This ordinance shall be in force and take effect after its publication in the Goodland Star News.
