ORDINANCE NO. 1785

AN ORDINANCE ADOPTING AND AMENDING THE 2018 INTERNATIONAL FIRE CODE CHAPTER 6 SECTION 6-201 AND AMENDING THE TEXT IN SECTION 6-202, SECTION 6-203 AND SECTION 6-204 IN THE MUNICIPAL CODE OF THE CITY OF GOODLAND, KANSAS.

WHEREAS, the City of Goodland Construction Board and Sherman County Fire Department Fire Chief has recommended to approve adopting and amending the 2018 International Fire Code for the Municipal Code of Goodland, Kansas.

            WHEREAS, the Governing Body finds it is in the best interest of the City to adopt the 2018 International Fire Code for the City of Goodland.

            NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GOODLAND, KANSAS:  

Section 1. The City of Goodland Code Section 6-201 is amended as follows:

Sec. 6-201. – Adoption of Fire Code.

There is hereby adopted by the governing body of the City of Goodland, Kansas, for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code and standards known as the 2018 International Fire Code, and the whole thereof, save and except such portions as hereinafter deleted, modified or amended by section 6-205, of this article two copies which code and standards have been and are now filed in the office of the clerk of the City of Goodland, Kansas, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this article shall take effect, the provisions thereof shall be controlling within the limits of the City of Goodland, Kansas.

Amendments to the 2018 International Fire Code.

  1. Chapter 1 Section 101.1 Title. These regulations shall be known as the Fire Code of the City of Goodland, hereinafter referred to as “this code.”
    1. Chapter 1 Section 110.4 Fine Amounts. Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documentsor directive of the fire code official, or of a permit or certificate used under provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not more than $1000.00dollars or by imprisonment not exceeding 30, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
    1. Chapter 1 Section 112.4 Failure to Comply. Any person who shall continue any work after having been served with a stop work order, except such work as that a person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than $200.00 or more than $2000.00.
    1. Chapter 9 Section 903.2.8.1 Group- R-3. Is hereby omitted.
    1. Chapter 11 Section 1103.5.3. Is hereby omitted
    1. Chapter 57 Section 5704.2.9.6.1 Locations where above ground tanks are prohibited. Storage of Class I and II liquids in above-ground tanks outside of buildings is prohibited within the limits established by law as the limits of districts in whish storage is prohibited in R-1, R-2, M-P, C-1 and D-MU zone districts.
    1. Chapter 57 Section 5706.2.4.4Locatrions where above-ground tanks are prohibited. The storage of Class I and II liquids in above-ground tanks is prohibited within the limits established by law as the limits of districts in which such storage is prohibited in R-1, R-2, M-P, C-1 and D-MU zone districts.
    1. Chapter 58 Section 5806.2 Limitations. Storage of flammable cryogenic fluids in stationary containers outside of buildings is prohibited  within the limits established by law as the limits of districts in which such storage is prohibited in R-1, R-2, M-P, C-1 and D-MU zone districts.
    1. Chapter 61 Section 6104.2 Maximum capacity within established limits. Within the limits established by law restricting the storage of liquefied petroleum gas for the protection of heavily populated or congested areas, the aggregate capacity of any one installation shall not exceed a water capacity of 2,000 gallons (7570 L) in which such storage is prohibited in R-1, R-2, M-P, C-1 and D-MU zone districts.

SECTION 2. Section 6-202 is hereby amended to read as follows:

Sec. 6-202. – Establishments and Duties of the local Fire Department.

(a) The adopted Fire Code in Section 6-201 shall be enforced by the Local Fire Department in the City of Goodland which is hereby established and which shall be operated under the supervision of the chief of the fire department.

(b) The chief in charge of the Local Fire Department shall be appointed by the city manager.

SECTION 3. Section 6-203 is hereby amended to read as follows:

Sec. 6-203. – Definitions.

Wherever the word “jurisdiction” is used in the adopted Fire Code in section 6-201, it is The City of Goodland, Kansas.

SECTION 4. Section 6-204 is hereby amended to read as follows:

Sec 6-204. Establishment of limits of districts in which storage of flammable or combustible liquids in outside above ground tanks is prohibited.

The limits referred to in the adopted Fire Code in Section 6-201 in which the storage of flammable or combustible liquids is restricted are hereby established as follows: all areas zoned as D-MU, R-1, R-2 and M-P, except the city planning commission is hereby authorized to grant variance in the C-1 zone district from the restrictions imposed by the above enumerated sections if they find that a variance will not unduly endanger lives or property.

SECTION 5. This ordinance shall be in force and take effect after its publication in the Goodland Star News.
