GOODLAND CITY COMMISSION

Regular Meeting

 

November 4, 2019                                                                                                                 5:00 P.M.

Vice-Mayor Jay Dee Brumbaugh called the meeting to order with Commissioner Annette Fairbanks, Commissioner John Garcia, and Commissioner Jacque Schields responding to roll call.  Mayor Brian Linin was reported absent.

 

Also present were Dustin Bedore – Director of Electric Utilities, Joni Showalter-Police Chief, Brian James – Fire Chief, Mary Volk – City Clerk, and Andrew Finzen – City Manager.

PUBLIC HEARING

  1. Waiver of Distance Limitation: Westport on Main – Vice-Mayor Brumbaugh opened hearing at 5:00 p.m. Ann Myers stated, we previously had a restaurant and would like to change a few things, adding the option for a beer or drink with meal.  Our menu will not change a lot just adding an extra touch.  Commissioner Fairbanks asked, will you be open evenings?  Ann stated, plans are to open Tuesday through Saturday 7:00 a.m. to 2:00 p.m., Sundays 10:00 a.m. to 2:00 p.m., and Friday and Saturday nights 5:00 to 9:00 p.m.  Vice-Mayor Brumbaugh closed hearing at 5:03 p.m.

 

PUBLIC COMMENT

  1. Dean Graber, resident 802 Colorado – Dean stated, I am making a request to the Commission to have my alley fixed between Colorado and Wyoming Avenues and 8th and 9th While doing Kiwanis flags I talked to Rich about alley.  When it was not addressed, I left message with staff for Andrew to get it addressed.  The trash trucks use alley and really tear it up.  I have been asking for a while and would like to get it fixed.  Andrew stated, you discussed with me after the last meeting and my intention was to address with Rich when he gets back from vacation.  He has been out helping with harvest.  Dean stated, I visited with Rich and he indicated they were finishing up Enterprise Road, then will address.  That has been some time, I just want it fixed because it is rough and dangerous to walk on, especially after dark.  Andrew stated, I encourage if a department head does not address an issue as you would like to feel free to contact me.

 

CONSENT AGENDA

  1. 10/21/19 Commission Meeting Minutes
  2. Appropriation Ordinances: 2019-21, 2019-21A, and 2019-P21
  3. Authorization to Apply for KDOT Public Transportation Assistance Grant

ON A MOTION by Commissioner Garcia to approve Consent Agenda seconded by Commissioner Schields.  MOTION carried on a VOTE of 4-0.

 

ORDINANCES AND RESOLUTIONS

  1. Resolution 1556: Waiver of Distance Limitation for Westport on Main – ON A MOTION by Commissioner Garcia to approve Resolution 1556: Waiver of Distance Limitation for Westport on Main seconded by Commissioner Fairbanks. MOTION carried on a VOTE of 4-0.
  2. Resolution 1557: Stop Sign at 7th and Eustis – Andrew stated, resolution is approving placement of stop sign at 7th and Eustis, stopping traffic on 7th Commission requested I send notice to property owners, asking for input and have not received any response.  Brian stated, I use that entry to my home now, and agree stop sign is a good idea with students flying intersection.  ON A MOTION by Commissioner Fairbanks to approve Resolution 1557: Stop Sign at 7th and Eustis seconded by Commissioner Garcia.  MOTION carried on a VOTE of 4-0.

 

DISCUSSION ITEMS

  1. Review of Board Applicants – Andrew stated, Abby Killingsworth submitted application for appointment to Parks and Recreation/Tree Board.  There is one vacancy for a three year term. The board approved her application and recommend Commission approval.

 

REPORTS

  1. City Manager – 1. We will tour dispatch after meeting if Commission is able.  Contractor is 98% complete at this time.  Dispatch will need to get equipment needs which is their responsibility.  Commissioner Garcia asked, when will dispatch be complete?  Andrew stated, the main area is done at this point, but should have final touches complete this week.  In December or January when all equipment is in we will tour it again to see fully operation. 2.  LKM Regional Supper is Wednesday in Wakeeney to discuss legislative priorities.  I will be attending.    Reminder City Offices are closed November 11th, 28th and 29th for Holidays.  4.  Staff is working to get health assessments complete and begin quoting insurance.  5.  Enterprise Road will require another pour.  They are trying to complete before fall, weather permitting.  Project is coming along very well, staff has done a good job.  They will pour section of alley behind post office tomorrow to open next week.  6.  We are starting to get into winter and have a lot of staff working after hours in weather, keep them in thoughts this season.  7.  We have a few bids out; Audit Services, Topside Trail, Grave Opening Services.
  2. Fire Chief/Building Inspector – Brian stated, I am working on County inventory, including Kanorado and Brewster, then will get replacement costs for equipment.  The City portion is complete. I know it has taken awhile but we have a lot of loose equipment, in addition to apparatus.  This is record year for Fire Department calls with 130 year to date.  Colby averages seventy-five to eighty a year.  Calls for Rural Fire is eighty to date.  Brewster has had eighteen calls and Kanorado 38.  Calls for structure fires is high as we are at four to date, when we average two a year.  Commission should be proud of your firemen; they do a good job and take job serious.  ISO came out for evaluation, we are waiting on results.  Construction of Holiday Inn requires a plan revision approved by engineer.  Since you approved the garage ordinance we have not had a lot of requests to build garages on vacant lots.  Dakota is reviewing site triangle violations and vehicles in front yard.  Vice-Mayor Brumbaugh asked, have you discussed Building Inspection job and who will do job duties?  Brian stated, no, but if City felt it was beneficial for me to continue as Building Inspector for City I would not be against it; however, my passion is Fire and EMS.  The design of the position is a City issue because if fire is merged, I am a County employee.  I will continue enforcing Fire Codes for City.  Vice-Mayor Brumbaugh stated, I want it to work for both sides.  Initially I felt we should leave position with City but we need to address if you are over loaded.  Commissioner Garcia stated, Brian has been doing job a long time and if it will work in schedule with fire being your main responsibility, I believe it would be beneficial for City and recommend Brian remain in role.  Brian stated, right now I am a City employee and contract with County but role will be switched if merge.  Commissioner Garcia asked, how long do you think it will take to get inventory complete?  Brian stated, I am hoping to have information turned over to attorneys by end of month.  We are looking at proceeding with nuisance abatement at Motel 7.  At fire training this week we are climbing the elevator.
  3. Commissioners

Vice-Mayor Brumbaugh – 1.  Did we have anyone at the meeting referenced in text from Gennifer House?  Seems like all communities were represented but Goodland.  Andrew stated, it is tough to know which meetings are beneficial to attend.  Commissioner Schields stated, it would be good to have her talk to Commission about program.  2.  Go vote and exercise your right.  Good luck to everyone.

Commissioner Fairbanks – 1.  Gennifer House sent City and County Commissioner’s a link to podcast Shrinking Smart.  It is short and well worth your time.  2. Good luck on election, wish everyone best of luck.

Commissioner Schields – 1.  I was out at Enterprise Road, staff has made good progress and it looks good.  Replacing 25th Street is an improvement.  Andrew stated, 25th Street is built with right depth to last and handle truck traffic.

Commissioner Garcia – 1.  I echo Commissioner Schields comments on street improvements.  2.  I received call from Senator Billinger regarding 24/7 project.  He heard from food vendor concerned will not make money with State restricting entrance.  I feel we need to get State and Commission to meet about entrance since these entrances have been allowed in other communities.  I feel Andrew should contact State to setup a meeting to ask questions.  This improvement is crucial to Goodland and they need to have both entrances from highway with truck traffic.  Andrew stated, we met with KDOT Highway Access Control Manager and other teams, the answer was rigidly no from the start.  They have purchased access control there so are against it.  I believe entrances in many other communities went in before rule was in place.  KDOT has access control and they can say no just because.  Staff concurs and will reach out to anyone to overturn the decision.  Do you have contact information?  Commissioner Fairbanks asked, can Senator Billinger be present at meeting to help the City?  Commissioner Garcia stated, I will see who contact is and see if he can be present.  It will be to the City’s benefit to meet again.

ADJOURNMENT WAS HAD ON A MOTION Commissioner Garcia seconded by Commissioner Fairbanks.  Motion carried by unanimous VOTE, meeting adjourned at 5:48 p.m, followed by short tour of Dispatch Center.  Next meeting is scheduled for November 18, 2019.
