A RESOLUTION: AUTHORIZING AND EMPOWERING MAYOR JOHN GARCIA TO ENTER INTO AN ASSIGNMENT OF LEASE AND EASEMENT AGREEMENT WITH TPA V, LLC FOR THE PAYMENT OF FIFTY THOUSAND DOLLARS ($50,000.00) BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF GOODLAND, KANSAS AS FOLLOWS: WHEREAS, the City of Goodland, Kansas entered into a certain Land Lease Agreement dated February 29, 2016, by and between City of Goodland Kansas and Alltel Communications, LLC d/b/a Verizon Wireless, as evidenced by that certain Memorandum of Land Lease Agreement dated February 29, 2016 and recorded March 28, 2016 in Book 187, Page 83, Official Public Records of Sherman County, Kansas (the “Lease”), for a specific portion of property located at 204 West I I” Street, Goodland, Kansas (herein the “Property”); and WHEREAS, the City has been offered a significant amount to assign the Lease and provide an easement to TPA V, LLC (herein “TPA V”); and NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF GOODLAND, KANSAS APPROVES THE FOLLOWING FORMAL ACTION, AS FOLLOWS: Section C. Tower Point Lease – Cherise stated, I have read through informationfrom Alan Lanning and discussed lease with Jake Kling, City Attorney. It appears to be a good agreement for $50,000 up front. The only risk is if they do not put any additional services on tower. Jake stated, they can add other utilities to the tower and City receives 50% of the lease payment above current monthly rate. Mayor Garcia asked, how do we know when new customers are added? Jake stated, TowerPoint is obligated to notify City of new customers and rate per the agreement. ON A MOTION by Vice-Mayor Brumbaugh to approve proceeding with process on the Tower Point Lease seconded by Commissioner Farris. MOTION carried on a VOTE of 5-0. This resolution shall become effectively immediately upon passage. Adopted this 28th day of July, 2021
