ORDINANCE NO. 1808

AN ORDINANCE PERTAINING TO UTILITIES IN THE CITY OF GOODLAND, AMENDING SECTIONS 17-202, 17-203, 17-204 and 17-401 OF THE CODE OF THE CITY OF GOODLAND.

WHEREAS, pursuant to K.S.A. Article 66 Section 104, the City of Goodland has the power and authority to control and regulate all public utilities and common carriers situated and operated wholly or principally within any city or principally operated for the benefit of such city or its people, and

WHEREAS, the City has the power and authority to pass rates, rules, and regulations governing the operation of those municipal utilities; and

WHEREAS, the City deems it necessary to adjust rates to maintain a fiscally sound

enterprise fund; and

WHEREAS, the City sought the assistance of Muniworth, dba Waterworth, to review and adjust rates in Sections 17-202, 17-203, 17-204 and 17-401 of the Code of the City of Goodland while eliminating a monthly cost adjustment that will no longer be added to monthly electrical utility bills for all classes of electric customer of the City of Goodland, Kansas until reviewed and revised to meet extraordinary power purchase costs only. Said adjustment was known as operational cost adjustment charge (OCA) and was calculated according to total monthly operating costs in Section 17-205; and

WHEREAS, it is in the best interests of the public health, safety, and welfare that this

amendment to the electric utility services rates and charges be made; and now

THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GOODLAND, KANSAS:

            Section 1. Section 17-202of the Code of the City of Goodland, Kansas is hereby amended as follows:

            (a)        Customer charge in city: $18.90 per meter.

            (b)        Customer charge outside city: $37.80 per meter.

            (c)        Energy charge for 0 – 500 KWH: $0.1422 per KWH.          

                        Energy charge for 501-1000 KWH: $0.1461 per KWH.

                        Energy charge for 1001+ KWH: $0.1499 per KWH.

            Section 3. Section 17-203of the Code of the City of Goodland, Kansas is hereby amended as follows:

            (a)        Customer charge in city: $31.50 per meter.

            (b)        Customer charge outside city: $63.00 per meter.

            (c)        Energy charge: $0.1375 per KWH.

            Section 4. Section 17-204of the Code of the City of Goodland, Kansas is hereby amended as follows:

            For those customers meeting the criteria as set forth in section 17-201 of the Code of the City of Goodland to be classified as a large commercial customer the rates for electrical service shall be as follows:

            (1)        Customer charge, in city:  $18.90 per meter.

(2)        Customer charge, outside city:  $37.80 per meter.

(3)        Energy charge: $0.1125 per KWH

            (4)       Metered demand charge: $11.40 per KWH

(5)       All users in this section shall be subject to a demand charge. The current monthly demand charge shall be established by the highest measured demand (corrected for power factor if required) during any 15-minute period occurring during the current billing cycle, reset monthly.

Section 5. Section 17-401 of the Code of the City of Goodland, Kansas is hereby amended as follows:

            Any household whose total annual income according to the number of persons in the household is less than the poverty guidelines updated periodically in the Federal Register by the U.S. Department of Health and Human Services under the authority of 42 U.S.C. 9902(2), shall be eligible for a monthly low-income electric rate, which shall be charged as follow:

EFFECTIVE DATE: This ordinance shall take effect and be in full force and effect for all Utility Customers of the City of Goodland billed for usage on or after January 1, 2026 and after publication in the official city newspaper.
